These Terms of Use (“Terms”) govern your access to and use of the BalkanTruck mobile application and related services (together, the “Service”), operated by BalkanTruck (“we”, “us”, “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The Service is intended for professional drivers and is not directed at children. You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this requirement and that all information you provide is accurate. We remove accounts we identify as belonging to a person under 18.
BalkanTruck is an information and community platform for truck drivers in the Balkan region, including a discussion forum, public chat channels for road conditions and border crossings, direct messages between users, and a private route log (Dnevnik).
The Service is free. BalkanTruck is provided free of charge. There are no paid features, subscriptions, in-app purchases, or premium tiers, and no fee is charged to create or keep an account. Every feature of the App is available to every registered user at no cost.
Important — user-submitted information is not official or guaranteed. Traffic conditions, border-crossing wait times, police/radar locations, and road conditions posted by users are submitted voluntarily by other users and are provided “as is,” for general informational purposes only. You are solely responsible for your driving and routing decisions. Do not rely on content in the App as your sole source of information for safety-critical decisions.
“User Content” means anything you post, upload, or send through the Service — feed posts, forum topics/posts/comments, poll responses, chat messages, direct messages, images, and attachments. You retain ownership of your User Content, but you are solely responsible for it.
By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content solely as necessary to operate and provide the Service (e.g. showing your forum post to other users). This license ends when you delete the content or your account, except for copies retained as required by law or for legitimate backup/security purposes.
You agree not to post content or use the Service to:
We may, but are not obligated to, review, remove, or restrict access to any User Content, and suspend or terminate accounts, at our discretion — including in response to user reports — if we believe content or conduct violates these Terms or applicable law. We are not responsible for User Content posted by others.
If you encounter content or behavior that violates these Terms, contact us at contact@balkantruck.rs or use any in-app reporting feature available.
The Service, including its design, logos, and software (excluding User Content), is owned by BalkanTruck or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service except as permitted by these Terms or applicable law.
The Service may link to or rely on third-party services (e.g. map tiles, email delivery, and push-notification delivery by Google and Apple). We are not responsible for the content, policies, or practices of third-party services.
We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms, is harmful to other users, us, or third parties, or for any other reason at our discretion. You may stop using the Service and request account deletion at any time (see our Privacy Policy).
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY USER CONTENT, INCLUDING TRAFFIC, BORDER, OR ROAD-CONDITION REPORTS.
Push notifications are not guaranteed. Notifications are a convenience, not a delivery service. They depend on your device, its operating system, its battery and power-saving settings, your network connection, and Google’s and Apple’s notification services — none of which we control. A notification may arrive late, arrive silently, be grouped with others, or not arrive at all, and notifications about public chat channels are sent as occasional summaries rather than one per message. Do not rely on notifications to learn about road conditions, border waits, or anything else time-critical. Open the App and check.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BALKANTRUCK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR PROFITS, ARISING FROM YOUR USE OF THE SERVICE OR RELIANCE ON ANY CONTENT WITHIN IT, INCLUDING USER-SUBMITTED TRAFFIC OR ROAD INFORMATION. THE SERVICE IS PROVIDED FREE OF CHARGE, AND OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED ONE HUNDRED EUROS (EUR 100).
Nothing in these Terms limits liability that cannot be limited or excluded under applicable law.
You agree to indemnify and hold harmless BalkanTruck from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your violation of these Terms.
We may modify or discontinue the Service, or update these Terms, at any time. If we make material changes to these Terms, we will notify you via the App or by email before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of Serbia, without regard to conflict-of-laws principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of Serbia, unless applicable law requires otherwise.
