These Terms of Use (“Terms”) govern your access to and use of the BalkanTruck mobile application and related services (together, the “Service”), operated by BalkanTruck (“we”, “us”, “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this requirement and that all information you provide is accurate.
BalkanTruck is an information and community platform for truck drivers in the Balkan region, including a social feed, discussion forum, group and direct chat, and user-submitted traffic/border/parking reports.
Important — user-submitted information is not official or guaranteed. Traffic conditions, border-crossing wait times, police/radar locations, road conditions, and parking availability posted by users are submitted voluntarily by other users and are provided “as is,” for general informational purposes only. You are solely responsible for your driving and routing decisions. Do not rely on content in the App as your sole source of information for safety-critical decisions.
“User Content” means anything you post, upload, or send through the Service — feed posts, forum topics/posts/comments, poll responses, chat messages, direct messages, images, and attachments. You retain ownership of your User Content, but you are solely responsible for it.
By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content solely as necessary to operate and provide the Service (e.g. showing your forum post to other users). This license ends when you delete the content or your account, except for copies retained as required by law or for legitimate backup/security purposes.
You agree not to post content or use the Service to:
We may, but are not obligated to, review, remove, or restrict access to any User Content, and suspend or terminate accounts, at our discretion — including in response to user reports — if we believe content or conduct violates these Terms or applicable law. We are not responsible for User Content posted by others.

The Service, including its design, logos, and software (excluding User Content), is owned by BalkanTruck or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service except as permitted by these Terms or applicable law.
The Service may link to or rely on third-party services (e.g. map tiles, email delivery). We are not responsible for the content, policies, or practices of third-party services.
We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms, is harmful to other users, us, or third parties, or for any other reason at our discretion. You may stop using the Service and request account deletion at any time (see our Privacy Policy).
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY USER CONTENT, INCLUDING TRAFFIC, BORDER, OR ROAD-CONDITION REPORTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BALKANTRUCK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR PROFITS, ARISING FROM YOUR USE OF THE SERVICE OR RELIANCE ON ANY CONTENT WITHIN IT, INCLUDING USER-SUBMITTED TRAFFIC OR ROAD INFORMATION. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED [amount, e.g. the amount you paid us in the past 12 months, or a fixed nominal amount if the Service is free].
Nothing in these Terms limits liability that cannot be limited or excluded under applicable law.
You agree to indemnify and hold harmless BalkanTruck from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your violation of these Terms.
We may modify or discontinue the Service, or update these Terms, at any time. If we make material changes to these Terms, we will notify you via the App or by email before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of Serbia, without regard to conflict-of-laws principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of Serbia, unless applicable law requires otherwise.
